Binding Agreement

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "your") and Modern Move LLC dba Modern Move ("Modern Move," "we," "us," or "our"), governing your access to and use of the website located at amodernmove.com ("Site") and all related services. Modern Move LLC is organized under the laws of the United States, with a mailing address at 4125 W Waters Ave, Tampa, FL 33614.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Site. We reserve the right to modify these Terms at any time. This authorization takes precedence over any previous registration on any federal or state Do Not Call registry. You may revoke your consent to receive SMS messages at any time by replying STOP, END, QUIT, or UNSUBSCRIBE to any message. After you opt out, you will receive a single confirmation message and no further SMS messages will be sent unless you opt in again. For assistance, reply HELP to any message.

Message frequency varies based on your account activity and our content schedule. Msg & data rates may apply. Your mobile carrier's standard messaging and data rates apply to all SMS messages sent and received.

We do not sell, rent, lease, or share your mobile phone number or SMS opt-in data with any third parties, affiliates, or partners for their own marketing or promotional purposes.

Binding Arbitration and Class Action Waiver

Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Site, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Hillsborough County, Florida, unless the parties mutually agree to a different location or virtual proceedings. Judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: YOU AND MODERN MOVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and Modern Move agree otherwise, the arbitrator may not consolidate the claims of more than one person and may not otherwise preside over any form of a representative or class proceeding.

Opt-Out: You have the right to opt out of this arbitration agreement by sending written notice to Modern Move LLC, 4125 W Waters Ave, Tampa, FL 33614, within 30 days of first accepting these Terms. If you opt out, you and Modern Move agree to resolve disputes exclusively in the state or federal courts located in Hillsborough County, Florida.

Governing Law
